Abstract

Lack of awareness of the community in maintaining the cleanliness of the surrounding environment causes a disaster. Baleendah District, Bandung Regency is one of the areas that experiences floods every year. Therefore, residents need to know the importance of maintaining the cleanliness of the surrounding environment in order to reduce the adverse effects of floods that hit the settlements. The insight into how important it is to maintain cleanliness through the da^wah route is one important thing. Moreover, the majority of residents are Muslim. Therefore, preachers as propagators of Islamic da^wah messages are required to not only convey religious messages, but also issues related to people^s daily lives from a religious perspective. This paper is based on the study of public speaking in the context of Islamic da^wah. Using descriptive quantitative research methods with respondents from prospective preachers who joined the Indonesian Ulama Council in Baleendah District, Bandung Regency. The aim is to reveal the knowledge and understanding of preachers about the rhetoric of da^wah, ethics and aesthetics of preaching, to protect the environment from an Islamic perspective, and to become memorable speakers. Thus, it is hoped that prospective preachers in conveying their da^wah will first learn about issues that occur in the surrounding environment, one of which is the issue of annual floods, so that the message of da^wah can touch the real problems of society and help provide solutions to these problems.

Abstract

Madrasah communities are interesting to be empowered, because madrasas are the oldest education system in Indonesia. It is a unique socio-cultural phenomenon and its existence has been tested by history and continues today. In addition, madrasas are an educational system that has historical roots in the nation^s traditions and culture. The problem they face is the low level of knowledge and skills about cutting-edge learning methods that are creative, active, effective and fun, but they have a strong desire to improve the quality of themselves and the quality of learning in a better direction, so that they are able to produce a smart nation. Intellectually, emotionally, and spiritually as expected.. Therefore, the issue raised in this empowerment is the increase in the professionalism of madrasa teachers. Abstract

This paper discusses the communication dynamics of Ahmadis in building social relations with the people outside their community after they received various forms of persecution. In Indonesia, Ahmadis have been the subjects to persecution in at least four regions: West Java, East Java, Banten and West Nusa Tenggara (Nusa Tenggara Barat [NTB]). The persecution includes the sealing and burning of their mosques and was exposed by the media. Such religious persecution and discrimination shook the Ahmadiyya community, and their movement was made to some extent restricted. Ahmadiyya was a legal social-religious organization before several regulations such as Joint Ministerial Decree and local government regulations were issued to disband them. On top of that, the Indonesian Ulema Council (MUI) also issued a fatwa that Ahmadis are not Muslims and that they are misled and misleading. Ahmadis took legal action to regain their legality, but it was in vain. What is discussed in this paper is the result of our qualitative phenomenological study, the data of which were collected through interviews, documentary studies, and observation. The research locus included West Java, Banten, East Java, Jakarta and West Nusa Tenggara. We found that Ahmadis^ efforts to peacefully integrate themselves with society through social communication had not been fully successful. Their movement was still restricted. In terms of social activities, Ahmadis are inclusive, but they are exclusive in their religious activities. This notably implies that religion becomes a factor contributing to the social exclusion of the Ahmadiyya community.

Analysis Of Islamic Law Towards Article 181 Compilation Of Islamic Law

Faculty of Sharia Bandung Islamic University

Abstract

The issue of inheritance distribution in Islam discussed in Chapter II of the Compilation of Islamic Law (KHI). Article 181 KHI describes a person who dies without leaving a child and father, so brothers and sisters who are one mother, each one gets 1/6. Q.S Al-Nisa verse 12, it is known that what is meant by kalalah is a person (male or female) who died while he has no children and father but has one brother or one sister who is one mother, then each one receives a share of 1/6 of the estate. If we look closely, there are differences in the text that need to consider, namely brothers and sisters who are one mother get 1/6 of the share with brothers or sisters, then each will get 1/6. This study aims to analyze the share of inheritance for brothers and sisters in article 181 KHI using an analysis of Islamic Law. This study used a qualitative method with a normative juridical approach, then analyzed using interactive analysis by reducing data, presenting it, and concluding. The results of this study indicate that the share of inheritance for a brother or sister is 1/6 if the heir does not leave the child and father. The use of the words -and- in article 181 KHI is identical to the difference in understanding that 1/6 given to two people, namely a brother and sister, who is one mother, not one of the two. Whereas in the Islamic inheritance law, it explained that if there are two or more brothers or sisters who are one mother, then the portion that will obtain is 1/3 of the inheritance left behind.

Halal Certification and Public Morality in the Frame of GATT-WTO 1994

Faculty of Law, Bandung Islamic University

Abstract

The majority of Indonesian are Moslems. Constitutionally, the state has an obligation to guarantee the implementation of Islamic law, such as a guarantee for halal food products. The Act Number 33 of 2014 concerning Halal Product Guarantee was formed to fulfil this obligation by providing assurance that food products circulating in Indonesia must wear a halal certification. However, this action is considered contrary to the principle of non-discrimination in the frame of GATT-WTO 1994, even though the GATT-WTO provides an exception to the application of this principle if it is to protect public morality. As Indonesia is a member state of WTO. One of the obligations of WTO member countries is to eliminate discriminatory treatment in international trade. Hence, the interpretation of public morality in the frame of GATT-WTO in accordance with halal certification has been the main research problem. This study used normative legal research, which was primarily based on the secondary data by way of conducting library research. The study will answer the problem of whether the guarantee of carrying out religious orders is included in the category of public morality in the GATT-WTO.

Abstract

Intelligence is the spearhead for domestic defense in a country. There are several main tasks that make the State Intelligence Agency the spearhead of domestic defense. Namely, providing analysis related to domestic security, conducting investigations related to indications relating to terror, conducting security in certain matters, even intelligence can arrest someone who is strongly suspected of being linked to a terror network. The criminal act of terrorism is a trans-border crime, terrorism that has developed into a very dangerous, organized, widespread, systematic network. Terrorist operations are usually carried out by specially trained and organized clandestine elements. Many countries include their intelligence to play an active role in countering terrorism. The intelligence perspective in countering terrorism is needed on a strategic spectrum. The ability of intelligence to seek information, process information and present information for decision making is essential in supporting counter-terrorism measures. Intelligence information is needed considering that acts of terrorism are compiled and carried out in private using the clandestine method (covert activities). Terrorism groups operate in secret. To read and analyze these movements requires intelligence and counterintelligence capabilities. The purpose of this research is to find out how to optimize the role and function of intelligence agencies in the prevention of terrorism in Indonesia.

Abstract

One of the developments for the public interest is in the field of toll road construction. Toll road construction has an important effect on smoothing the flow of goods and services distribution. improving the quality of life and human welfare, which includes increasing the value of consumption, increasing labor productivity and access to jobs, as well as increasing real prosperity, and the realization of macroeconomic stability. Macroeconomic stability, namely fiscal sustainability, the development of the credit market, and its impact on the labor market.
Indonesia through Law Number 25 of 2007 concerning Investment, has provided a legal umbrella for the implementation of investment in Indonesia, in order to ensure legal certainty for both the interests of investors and Indonesia as the host country. Investments in toll road construction are legalized through the Toll Road Concession Agreement (PPJT) between the government and investors. This PPJT is a form of agreement using the Build Operation Transfer (BOT) pattern, which is commonly applied in infrastructure development agreements between the government and investors.
PPJT in its implementation experiences problems when it is related to land. To carry out Toll Road construction, investors must first go through the land acquisition stage. Land acquisition becomes difficult when the land to be acquired is land that is being controlled or owned by individuals, it often gets controversy. This condition causes the toll road construction process to become obstructed, which in turn has an impact on investment.

Abstract

On a national scale, the number of people exposed to Covid-19 is still high, and it began to growing attention from the scientific community. This study uses a normative juridical research method with the anthropology of law approach, the data sources used obtained from literature studies, and analysis techniques obtained from literature and document studies. It is a challenge that must be faced because of the disobedience of them to it because it does not involve indigenous leaders in preventing the spread of Covid-19. Faculty Of Law, Islamic University Of Riau Jl. Kaharudin Nasution No. 113, Simpang Tiga, Kec. Bukit Raya, Kota Pekanbaru, Riau 28284

Abstract

The transition from indirect democracy in the New Order era to direct democracy during the Reformation was intended to provide an opportunity for all levels of society to participate in the democratic party to determine the President and Vice President that the people wanted and leave the dark period of Indonesia^s democratic system with an authoritarian character. The issues raised in this study are the democratization of the New Order President^s election system with the Reformation Age and the implications of the President^s direct election system for democracy in Indonesia. The research the authors do is included in the type of normative legal research. This study concluded that during the New Order era the President was elected by the People^s Consultative Assembly (MPR), by using a voting system and only MPR members had voting rights. So that this system is considered less democratic because it is determined by political power and tends to give birth to an authoritarian President. While the electoral system of the President of the Reformation, the President and Vice President are directly elected by all the people of Indonesia based on the most votes. So that this system more reflects the nature of transparency and democracy. The implication of the direct election of the President for democracy in Indonesia is the emergence of regional desintegrative attitudes. Considering the reality of religious and ethnic plurality in Indonesia, some people in certain regions prioritize the principle of equality with religion, ethnicity, and regions in choosing presidential candidate pairs.

Abstract

Politics has an essential role for the establishment and implementation of a system in various aspects, two of which are capitalist and Islamic economic politics with their respective political concepts. Therefore, this research was conducted to explain the differences between these politics systems and discover their influence in Indonesia. The method used normative legal study using secondary data collected through library study and analyzed qualitatively through interpretation. The results conclude that in the former system, the large capital owners are the masters of production sources, distribution mechanism, and consumption restrictions, who have the freedom principle of individual property ownership, and economic and free competition. Hence, it causes excessive accumulation and unequal distribution of wealth of unlimited free competition. Meanwhile, the latter system emphasizes individual freedom, social equality, social security, widespread wealth distribution, and individuals and society welfare. Hence, it causes balance and prioritizes the values of togetherness and cooperation.

Abstract

The musyarakah mutanaqishah contract is a contract that is not known in classical literature, but it is a development of musyarakah contract. This contract is a multi-contract domain because it combines several contracts. Discussions and debates conducted by the scholars regarding the legal status of musyarakah mutanaqishah contract deserve to be studied in depth, especially as stated in the fatwa of DSN-MUI. The purposes of this research are, first, to explain the construction of the musyarakah mutanaqishah contract in the fatwa of DSN-MUI- second, to discover the ijtihad method of DSN-MUI in formulating fatwa on musyarakah mutanaqishah. The research method used a normative juridical approach and descriptive analytical as its specification. The type of data used secondary data collected by library study method and qualitative data analysis. The results show that first, the musyarakah mutanaqishah contract in the fatwa of DSN-MUI uses a multi-contract concept (al-uqud al-murakkabah) and a binding promise concept (al-waad al-mulzim) which is based on the strongest opinion that the two concepts are legally allowed and second, the ijtihad pattern used by the DSN-MUI in formulating fatwa on the musyarakah mutanaqishah contract is based on the arguments in the form of Qur^an, hadith, the opinions of classical and contemporary scholars and maslahat considerations.

Abstract

When the curator settles the bankruptcy estate, the rights of the employees are fulfilled from the proceeds from the sale of budgets following the laws and regulations Even though the employee^s position is placed as special creditors, if the bankruptcy debtor^s liabilities are much greater than bankruptcy assets, the employee^s character as special creditors does not have a significant effect because usually the debtor^s assets are given first to the separatist creditors. This also happened to the bankruptcy of Tranka Kabel Ltd. and Nyonya Meneer Ltd. The methods of this research are normative juridical. The research specification is descriptive analytical, and the data analysis method is qualitative analysis with a deductive approach. Legal protection for workers or laborers to get wages or severance pay and other rights from companies that have been declared bankrupt in its implementation does not provide a sense of justice for workers, which is guaranteed constitutionally in Article 28D of the 1945 Constitution. This is marked by legal protection for workers or laborers at Tranka Kabel Ltd., and Nyonya Meneer Ltd., who are not optimal because not all of their rights in the form of wages are paid entirely by the bankruptcy company, while severance pay and other rights are not at all a priority in their payments.
