Death Penalty For Confidented Drugs Perspective Islamic Criminal Law

Abstract

In early Islam, the meaning of khamr was a kind of intoxicating drink made from grapes, dates, wheat and so on. The meaning of khamr has developed both from its type, name and danger. Narcotics in the context of Islamic law is a matter of ijtihadi, because drugs are not directly mentioned about their prohibition by the texts either Al-Qur^an or al-Sunnah, at the time of the Prophet Muhammad was only known as khamr. The research objective is to find out about the criminal sanctions for the perpetrators of drug abuse from the perspective of Islamic Criminal Law. The research methodology used is qualitative research methods through literature study, with the type of juridical normative research. Drug law is haram as well as haram khamr, so one of the criminal sanctions is the death penalty using a hierarchical approach because of the effects caused by drugs from all aspects.
