Abstract

One of the developments for the public interest is in the field of toll road construction. Toll road construction has an important effect on smoothing the flow of goods and services distribution. improving the quality of life and human welfare, which includes increasing the value of consumption, increasing labor productivity and access to jobs, as well as increasing real prosperity, and the realization of macroeconomic stability. Macroeconomic stability, namely fiscal sustainability, the development of the credit market, and its impact on the labor market.
Indonesia through Law Number 25 of 2007 concerning Investment, has provided a legal umbrella for the implementation of investment in Indonesia, in order to ensure legal certainty for both the interests of investors and Indonesia as the host country. Investments in toll road construction are legalized through the Toll Road Concession Agreement (PPJT) between the government and investors. This PPJT is a form of agreement using the Build Operation Transfer (BOT) pattern, which is commonly applied in infrastructure development agreements between the government and investors.
PPJT in its implementation experiences problems when it is related to land. To carry out Toll Road construction, investors must first go through the land acquisition stage. Land acquisition becomes difficult when the land to be acquired is land that is being controlled or owned by individuals, it often gets controversy. This condition causes the toll road construction process to become obstructed, which in turn has an impact on investment.
