Simplification of Implementing Regulations Formed by the President in Indonesia

Abstract

The phenomenon of overregulation experienced by the Indonesian state originates from the number of implementing regulations established by the President, thus naturally giving birth to a condition of hyper regulation. This study aims to analyze the essence of the implementing regulations established by the President, as well as the potential for simplification of these regulations without revising the P3 Law. The research method used in this research is normative juridical, with a qualitative approach. The results of this study are, in essence, the Government Regulations and Presidential Regulations are equivalent, because they receive the authority of the 1945 Constitution of the Republic of Indonesia (attribution). Meanwhile, implementing regulations for Presidential Decrees and Presidential Instruction are delegate regulations. Furthermore, it also describes the process of simplifying regulations, both in terms of form and substance and content.
