THE EXISTENCE OF EXTERNAL SUBJECTS IN THE EFFORTS OF RESOLVING INDUSTRIAL RELATIONS DISPUTES IN THE ERA OF DISRUPTION

Abstract

It is not easy to prevent industrial relations disputes, especially in the era of disruption. The purpose of this study is to describe the existence of external parties in industrial relations in an effort to prevent industrial relations disputes. This research is socio-legal studies. The results of this study were found that there were two subjects that played significant roles in the efforts of resolving industrial relations disputes. Internal subjects in industrial relations such as employers, workers or unions and work partners. External subjects in industrial relations such as stakeholders, namely the government, consultants, academicians, advocates, mediators, conciliators, arbitrators and judges. The existence of internal subjects was more dynamic in dealing with market demands in the era of disruption. There were changes in business processes that had impacts on industrial relations. There were changes in work quality parameters. The functions of the government in regulating, implementing and supervising the implementation of industrial relations has not been maximized. Positive responses from external subjects were needed to realize its existence. The conclusion is that the government is demanded to be more active in carrying out its functions so that external subjects can play active roles in resolving and preventing industrial relations disputes. The recommendation is that external subjects are required to develop their own qualities as the efforts to prevent industrial relations disputes.
